Acceptance of Terms

Welcome to TheSummitLog. By accessing or using TheSummitLog.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

TheSummitLog is a web-based platform that allows users to track mountain climbing achievements by integrating with third-party fitness services like Strava. We verify summit ascents using GPS data and provide digital records of your climbing accomplishments.

Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent that you meet this age requirement.

Account Registration

To use certain features of the Service, you must create an account by providing a valid email address and connecting your Strava account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

User Conduct

You agree to use the Service only for lawful purposes. You will not:

• Upload false or misleading information about your climbs
• Attempt to manipulate GPS data to fraudulently claim summits
• Use the Service to harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated scripts or bots to interact with the Service without permission
• Violate any applicable laws or regulations

Intellectual Property

All content on TheSummitLog, including text, graphics, logos, and software, is the property of TheSummitLog or its licensors and is protected by copyright and other intellectual property laws.

You retain ownership of any content you upload (such as custom notes or photos). By uploading content, you grant us a non-exclusive, worldwide license to use, display, and distribute that content as necessary to provide the Service.

Third-Party Integrations

Our Service integrates with Strava and may integrate with other third-party services in the future. Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

You acknowledge that:

• Strava may revoke our access to their API at any time
• Changes to third-party services may affect the functionality of TheSummitLog
• We are not liable for issues arising from third-party service disruptions

GPS Verification and Accuracy

TheSummitLog uses GPS data to verify summit achievements. You acknowledge that:

• GPS technology has inherent limitations and may not always be 100% accurate
• Verification is based on proximity to known summit coordinates and assigned confidence levels
• We do not guarantee that all summits will be detected or that verifications are error-free
• You are responsible for the accuracy of data uploaded from your connected accounts

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESUMMITLOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in content or for any loss or damage incurred as a result of the use of any content posted or shared through the Service

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100 USD.

Mountaineering Safety Disclaimer

Mountain climbing and hiking involve inherent risks, including serious injury or death. You are solely responsible for:

• Assessing your own skills and fitness level
• Planning safe routes and obtaining proper permits
• Checking weather conditions and forecasts
• Carrying appropriate gear and safety equipment
• Making sound decisions in the field

Never rely on GPS verification data or summit tracking information to make safety decisions. Always use proper navigation tools, follow established safety practices, and turn back if conditions become unsafe.

Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, including if we believe you have violated these Terms.

You may terminate your account at any time by contacting us at sevensummitsjourney@gmail.com. Upon termination, your right to use the Service will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property rights.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheSummitLog regarding the Service and supersede any prior agreements.
